RESOLVED UNANIMOUSLY that:
a. The application for the consolidation of Remainder Erf 428 and 13714, Durbanville, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015 (as amended) in accordance with the consolidation plan attached as Annexure C, and subject to the conditions set out in Annexure A.
b. The application for the rezoning of the consolidated Remainder Erf 428 and 13714, Durbanville from Single Residential Zoning 1: Conventional Housing (SR1) to Subdivisional Area Overlay Zone, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015 (as amended), subject to the conditions set out in Annexure A.
c. The application for the subdivision of the consolidated Remainder Erf 428 and 13714, Durbanville consisting of 48 General Residential Subzoning 1 (GR1), 2 Open Space Zoning 3 (private road and private open space), 1 Utility zoning (UT) and 1 Public Road (road widening) portions, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015 (as amended), as per the subdivision plan per Annexure C, subject to the conditions set out in Annexure A.
d. The following permanent departures relating to the consolidated Remainder Erf 428 and 13714, Durbanville, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015 (as amended):
i. 3m street building line in lieu of 5m on the Jagger Street (south) boundary, applicable to Portions 15 – 23 of the proposed subdivision
ii. 3m street building line in lieu of 5m on the Jagger Street (east) boundary, applicable to Portions 9 - 15 of the proposed subdivision
iii. Garage door setbacks of less than 5m from the internal kerb for proposed Portions 26, 29, 34 and 37, namely:
- Portion 26: 2m
- Portion 29: 1.5m
- Portion 34: 2m
- Portion 37: 1.5m
iv. No permeability on the sections of the street boundary wall within 4.5m of the Boland Way/ Jagger Street and Jagger Street (south)/ Jagger Street (east) intersections.
v. A vehicle ingress / egress within 10m from intersections for proposed Portions 1, 9, 16, 23, 24, 31, 32 and 39, namely:
- Portion 1: 4m
- Portion 9: 4m
- Portion 16: 3m
- Portion 23: 3m
- Portion 24: 5.9m
- Portion 31: 5.9m
- Portion 32: 5.9m
- Portion 39: 5.9m
vi. A carriageway crossing with a width of 8.5m in lieu of 8m.
e. The site development plan (including the Landscaping Plan and tree survey) attached as Annexure C for the development of consolidated erven 428 and 13714, Durbanville BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015 (as amended).
REASONS FOR DECISION:
The MPT APPROVED the application for the reasons as set out in Planner’s report and added an additional reason 7.8 that reads as follows:
7.8. The consolidation of the two erven allows for a better-integrated development with one vehicular access point. The double storey houses will provide surveillance onto the adjoining roads and the heavily landscaped perimeter will enhance the streetscape.
