RESOLVED by 3 votes to 1 that:
a. The application for rezoning of Erf 5019 Grassy Park from Single Residential 1 to Community 1 for a Place of Instruction and Place of Worship BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015, subject to the conditions contained in Annexure A.
UNANIMOUSLY RESOLVED that:
b. The application for departures for Erf 5019 Grassy Park as detailed in Annexure A BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015, subject to the conditions contained in Annexure A.
c. The application for City approval for Erf 5019 Grassy Park as detailed in Annexure A BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015, subject to the conditions contained in Annexure A.
REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report and agreed to the following changes:
Correct heading in paragraph 7.1 as follows:
7.1 Reasons for the recommended decision for approval relating to the application for rezoning, departures and city approval for the Place of Instruction (school) and Place of Worship may be summarized as follows:
Correct reason 7.1.4 as follows:
7.1.4 Limiting the scale of use as a Place of Instruction and Place of Worship will ensure that the intensification of use and level of activity generated by the uses will not compromise the residential character of the area.
Delete reasons contained in paragraph 7.2
Annexure A:
1.1 Rezoning from Single Residential to Community Zone 1 to permit a Place of Instruction (School) and a Place of Worship on the property.
Amend condition 1.8 as follows:
1.8 Parking departure to permit 3 on-site parking bays in lieu of 23 on-site parking bays.
Delete condition 2.1
Amend condition 3.1.1 as follows:
3.1.1 Notwithstanding the uses permitted in the Development Management Scheme, the following uses shall not be permitted:
- Clinic
- Rooftop Base Telecommunication Station
Replace condition 3.1.2 with the following:
3.1.2 That the applicant submit an SDP showing the part of the building to be used for a Place of Instruction and the part to be used for a Place of Worship and that the applicant indicate a suitable demarcated outdoor play area for children, to the satisfaction of the authorized official
Amend condition 3.1.4 as follows:
3.1.4 The number of learners on-site at any one time shall not exceed 30 unless the number is limited further by Department: City Health Services and that no more than 100 people may occupy the premises at any given time.
Add new condition 3.4.4 as follows:
3.4.4 That a Traffic Management Plan be submitted by the applicant for approval by the authorised official and that this plan give consideration to the following:
- Drop off and pick up arrangements for the place of instruction
- Parking arrangements, with the prohibition of parking on Yorkton Road
- Appointment of a parking attendant to be available when the place of worship is operational in order to control and manage traffic and parking
- Negotiating arrangements with the City to share use of the parking area abutting the sportsground
Renumber condition 3.5.1 to be 3.5.2
Add new condition 3.5.1 as follows:
3.5.1 That the indoor noise amplification level does not cause disturbance when measured from outdoors.
Update numbering sequence accordingly.
