UNANIMOUSLY RESOLVED that:
The following deviations be supported:
8.1.1 The deviation from the MSDF in terms of Section (9)(2) of the City of Cape Town, Municipal Planning By-Law, 2015 on Remainder Erf 644, Schaapkraal, in order to permit urban development comprising of residential, community and associated infrastructure uses, within a critical natural asset.
8.1.2 The deviation from the KSDF in terms of Section (9)(2) of the City of Cape Town, Municipal Planning By-Law, 2015 on Remainder Erf 644, Schaapkraal, in order to permit urban development comprising of residential, community and associated infrastructure uses, within a core biodiversity area.
The following applications be approved:
8.1.3 The application in terms of Section 42(a) of the City of Cape Town Municipal Planning By-Law, 2015 for the rezoning of Remainder Erf 644, Schaapkraal, Agriculture to Subdivisional Area Overlay Zone (for residential, public open space, community uses, utilities and public roads) BE APPROVED in terms of Section 98(b)(iii) of the City of Cape Town Municipal Planning By-Law, 2015 subject to the conditions attached to Annexure A.
8.1.4 The application in terms of Section 42(d) of the City of Cape Town Municipal Planning By-Law, 2015, for subdivision of the Remainder Erf 644, Schaapkraal, into 648 portions, as indicated on drawing no: 2.017-s1-02 dated 17/01/2024 BE APPROVED in terms of Section 98(b)(iii) of the City of Cape Town Municipal Planning By-Law, 2015 subject to the conditions attached to Annexure A.
8.1.5 The application in terms of Section 42(e) of the City of Cape Town Municipal Planning By-Law, 2015, for implementation of the abovementioned subdivision approval in 8 phases of the Remainder Erf 644, Schaapkraal, as indicated on drawing no: 2.017-s1-02 dated 17/01/2024 BE APPROVED in terms of Section 98(b)(iii) of the City of Cape Town Municipal Planning By-Law, 2015 subject to the conditions attached to Annexure A.
8.1.6 The application in terms of Section 42(i) of the City of Cape Town Municipal Planning By-Law, 2015, for consent use on Portions 546 and 332, as indicated on drawing no: 2.017-s1-02 dated 17/01/2024 BE APPROVED in terms of Section 98(b)(iii) of the City of Cape Town Municipal Planning By-Law, 2015 subject to the conditions attached to Annexure A.
REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report.
Annexure A
Delete condition 2.10
Add new condition 2.9A as follows:
2.9B That the Stormwater Management Plan be submitted for approval by the authorized official, also considering the findings of the GEOSS report dated 29 January 2021
