Resolution details

UNANIMOUSLY RESOLVED that:

a. The application for the rezoning of the property from a Single Residential Zone 1 to a Community Zone 1 as set out in Annexure A, for erf 1302 Ottery BE REFUSED in terms of Section 98(c) of the Municipal Planning By-law, 2015.

b. The application for departures as contained in Annexure A, for erf 1302 Ottery BE REFUSED in terms of Section 98(c) of the Municipal Planning By-law, 2015.

Add recommendation as follows:
c. The application for the relaxation of the title deed condition relating to building line setbacks for Erf 1302 Ottery BE REFUSED in terms of Section 98(c) of the Municipal Planning By-Law 2015.

d. The application for the deletion of title deed restrictions, as contained in the Annexure A, for Erf 1302 Ottery BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law 2015.

e. The application for the deletion of a condition of an existing approval, as contained in the Annexure A, for Erf 1302 Ottery BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law 2015.

REASONS FOR DECISION
The MPT partially APPROVED and partially REFUSED the application for the reasons set out in the Planner’s Report and agreed to the following changes:

Correct reason 7.1.4 as follows:
7.1.4 The provision of 2 on-street stop and drop bays will not sufficiently address the negative traffic and parking impacts experienced.


Correct reason 7.1.5 as follows:
7.1.5 While a Place of Instruction (primary school) is ordinarily embedded within residential communities, the activity in question is located on a property previously used as a dwelling house and thus the retrofitting of the use has compounded impacts associated with noise and traffic.
