RESOLVED UNANIMOUSLY:
That an administrative penalty in the amount of R1000.00 BE DETERMINED in terms of Section 129 of the City of Cape Town Municipal Planning By-Law, 2015 in respect of Remainder Erf 9645 Grassy Park for operating a house shop from a portion of the property in accordance with the plan attached as Annexure B.
REASONS FOR DECISION:
The MPT APPROVED the application for the reasons set out in the Planner’s report, except reason 6.4 which is amended as follows:
6.4. The house shop operates from a portion of the approved dwelling house. The gravity of the unauthorized land use contravention is considered moderate. The general public cannot enter the house shop; only the family on-site have access to this space. The house shop is visible to passers-by.
