UNANIMOUSLY RESOLVED that:
a. An administrative penalty of R 2 500.00 BE DETERMINED for the unlawful land use in terms of Section 129 of the City of Cape Town Municipal Planning By-Law, 2015 in respect of Erf 62, Eerste River.
b. An administrative penalty of R 2 500.00 BE DETERMINED for the unlawful land use in terms of Section 129 of the City of Cape Town Municipal Planning By-Law, 2015 in respect of Erf 63, Eerste River
c. An administrative penalty of R 500.00 BE DETERMINED for the unlawful building work in terms of Section 129 of the City of Cape Town Municipal Planning By-Law, 2015 in respect of Erf 63, Eerste River.
REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report and agreed to amend reason 6.4 as follows:
6.4 The gravity pertaining to the land use is considered to not be overly serious, as the property is only used for the parking / storage of vehicles, and no operations / business activities take place on site. Furthermore, the use is not out of character in the area, which is characterized by mixed uses which range from construction to commercial.
