UNANIMOUSLY RESOLVED that:
a. The application for subdivision of Erf 20587, Somerset West, into Portion A, Portion B and a Remainder, as reflected on plan no 20587SW-plan 2 dd February 2023 BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015, subject to the conditions contained in Annexure A.

b. The application for rezoning of Portion A of Erf 20587, Somerset West, and Remainder Erf 20587, Somerset West, from Local Business Zone 2 to General Business Zone 1 BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015, subject to the conditions contained in Annexure A

c. The application for rezoning of proposed Portion B of Erf 20587, Somerset West, from Local Business Zone 2 to Utility Zone BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015, subject to the conditions contained in Annexure A

d. The application for regulation departure from the DMS for proposed Portion A and Remainder Erf 20587 to permit parking closer than 10m to the street boundaries of the site, as reflected on plan no 20587 Somerset West/SDP 001/Rev E/dd 2022-4-20 BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015

e. The application for consideration of SDP No 20587 Somerset West/SDP 001/Rev E/dd 2022-4-20 to permit a shopping centre (Pick ‘n Pay) on Remainder Erf 20587, a drive through restaurant on Portion A and a substation on Portion B, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015, subject to the conditions contained in Annexure A

REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report

Annexure A
Under the heading Applications Granted, amend paragraph 1.1 as follows:
1.1 Subdivision of Erf 20587, Somerset West, into Portion A, Portion B and a Remainder, as reflected on plan no 20587SW-plan 2 dd February 2023 (as shown on Annexure E)

Under the heading Applications Granted, amend paragraph 1.5 a follows:
1.5 SDP No 20587 Somerset West/SDP 001/Rev E/dd 2022-4-20 (as shown in Annexure D) to permit a shopping centre (Pick ‘n Pay) on Remainder Erf 20587 and a drive-through restaurant on a Portion


Amend condition 2.42 as follows:
2.42 That, owing to the physical constraints at the proposed access to the site, delivery vehicles be restricted to 16 metres for the shopping centre and 11.5m for the drive-through

Amend condition 2.44 as follows:
2.44 That in order not to compromise progression along Sir Lowry’s Pass Village Road, due to the spacing of the traffic signals not being compliant with the Road Access Guideline, the Developer/Owner, at his/her own cost and to the standards of the Directorate: Urban Mobility, must synchronise signals along the Sir Lowry’s Pass Village Road, before granting of occupancy
