RESOLVED that:

The application for departures, as set out in Annexure A, for Erf 14028 Constantia, be approved in terms of Section 98(b) of the Municipal Planning By-Law, 2015, subject to the conditions contained in Annexure A.

REASONS FOR DECISION:

The MPT APPROVED the application for the reasons set out in the Planner’s report, except reasons 7.1.3 and 7.1.10 which are corrected as follows:

7.1.3. The existing trees and hedges along the common boundaries will mitigate the impact of the building, as will be retention of some of the trees and the new tree planting.
7.1.9. The amended proposal is desirable and will not have a significant impact on existing rights.
