RESOLVED UNANIMOUSLY:

That an administrative penalty in the amount of R3000 BE DETERMINED in terms of Section 129 of the City of Cape Town Municipal Planning By-Law, 2015 in respect of Erf 4526 Pelikan Park.

REASONS FOR DECISION:

The MPT APPROVED the application for the reasons set out in the planner’s report and added two additional reasons that reads as follows:

6.7. The safety and the structururalintegrity has not been assessed
6.8. The large extent, the long duration, the habitable double storey second dwelling and the contravention of Section 78 (providing wrong information regarding the duration of the contravention) warrants an increase in the penalty amount
