Resolution details

RESOLVED UNANIMOUSLY that:

a. The amendment of conditions 2.1-2.4 of the approval dated 22 July 2019 (case no 70376441) in respect of erf 6155, Kraaifontein, be approved, in terms of Section 98(b) of the Municipal Planning By-Law, 2015 (as amended), to read as follows (amendments underlined):

- Notwithstanding development rules permitted in General Business Zone 2 of the Development Management Scheme, the following are permitted:

Maximum floor factor (bulk) : 0.97
Maximum height : 4 and 2 storeyflats
Maximum coverage : maximum 32.4%
On-site parking : at least 147 bays
Street building lines : 2m and 3m as per the SDP

- That the proposed development be limited to a maximum of 134 residential units/flats (<100m² per unit).

- That the development shall be substantially in accordance with the approved site development plan no 2202-A101-1, 2202-A102-1, 2202-A103-1, 2202-A111-1, 2202-A112-1, 2202-A121-1, 2202-A131-1, 2202-A132-1, 2202-A141-1, 2202-A142-1, 2202-A151-1, 2202-A161-1, 2202-A202-1, 2202-211-1, 2202-A221-1, 2202-2202-A251-1, 2202-A261-1, attached as Annexure C.

- That the approved landscaping plan shall be implemented at the cost of the developer and shall be substantially in accordance with landscaping plan no 22582/IRR/001/0, 22582/LP/001/0, 22582/TSD/001/0, within 3 months of the City issuing an occupancy certificate and to the satisfaction of the City’s Environmental and Heritage Branch.

b. The deletion of condition 2.8 (outdated basement parking/stormwater requirement) of the approval dated 22 July 2019 (case no 70376441) in respect of erf 6155, Kraaifontein, be approved, in terms of Section 98 (b) of the Municipal Planning By-Law, 2015 (as amended).

c. The permanent departure to permit only 147 parking bays in lieu of 168 parking bays on erf 6155, Kraaifontein, be approved, in terms of Section 98 (b) of the Municipal Planning By-Law, 2015 (as amended) and in accordance with the approved Site Development Plan (Annexure C), and subject to the conditions attached as Annexure A.
d. The permanent departure to permit motorcycle parking bays 0m in lieu of 10m from the Visser Street Road Reserve, in respect on erf 6155, Kraaifontein, be approved in terms of Section 98 (b) of the Municipal Planning By-Law, 2015 (as amended) and in accordance with the approved Site Development Plan (Annexure C), and subject to the conditions attached as Annexure A.

The MPT APPROVED the application for the reasons as set out in the planner’s report.
