RESOLVED UNANIMOUSLY that:
a. The application for Council’s approval in terms restrictive title deed condition C.2, as set out in Annexure A, for Erf 8640 Hout Bay, BE REFUSED in terms of Section 98(c) of the Municipal Planning By-Law, 2015.
b. The application for consent in terms of Item 59(b) of the Development Management Scheme to permit a freestanding base telecommunication station, on Erf 8640 Hout Bay, BE REFUSED in terms of Section 98(c) of the Municipal Planning By-Law, 2015.
c. The application for departures, as set out in Annexure A, for Erf 8640 Hout Bay, BE REFUSED in terms of Section 98(c) of the Municipal Planning By-Law, 2015.
REASONS FOR DECISION:
The MPT REFUSED the application for the reasons set out in the Planner’s report, except reason 7.1.8 which is amended as follows;
7.1.8. Although the City supports telecommunication infrastructure, this needs to be done in a manner in which, inter alia, the visual and potential health impacts are minimized. On balance, the negative aspects of this proposal outweigh the benefits. There are alternative locations and solutions that can be explored that would result in a far more satisfactory outcome for the surrounding residents and the urban environment.
