RESOLVED UNANIMOUSLY that:
a. The application for the relaxation of title deed conditions and departures for additions to the dwelling house, as set out in point 1 of Annexure A, for Erf 61727 Cape Town, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015.
b. The application for the relaxation of title deed conditions, and departures for the outbuildings and the rooftop terrace in Annexure 5, as set out in point 2 of Annexure A, for Erf 61727 Cape Town, BE REFUSED in terms of Section 98(c) of the Municipal Planning By-Law, 2015.

1. APPLICATIONS REFUSED IN TERMS OF SECTION 98 (c) OF THE BYLAW RELATING TO THE OUTBUILDINGS PROPOSED:
2.1.1 To permit the building 0m in lieu of 3.15m from the rear (north) boundary as it relates to the domestic quarters and rooftop terrace.
Additional applications refused
2.2 Departures from Item 22 (d) of the Development Management Scheme
2.2.2. To permit the height of the building on portions of the building beyond 12m of the street to be 7.35m in lieu of 4m along the northern and eastern common boundaries as it relates to the rooftop terrace.
To permit the height of the building on portions of the building within 3m of the common boundary to be 7.35m in lieu of 4m along the western, northern and eastern common boundaries as it relates to the rooftop terrace.
REASONS FOR DECISION:
The MPT partially APPROVED and partially REFUSED the application for the reasons set out in the planner’s report
