RESOLVED UNANIMOUSLY that:
a. The application for removal of conditions (III)3.(a),(b)(c) and (d) of Title Deed No T176/2021 for Erf 2144, Somerset West, BE APPROVED in terms of Section 98(b) of the Municipal Planning Bylaw, 2015
b. That the application for removal of conditions C.3.(a)(c) and (d) of Title Deed No T45352/2020 for Erf 2147, Somerset West, be approved in terms of Section 98(b) of the Municipal Planning Bylaw, 2015
c. That the application for deletion of conditions of establishment of Lionviham Township as far as they pertain to Erven 2144 & 2147, Somerset West, BE APPROVED in terms of Section 98(b) of the Municipal Planning Bylaw, 2015
d. That the application for rezoning of Erf 2144, Somerset West, from General Residential Zone 2 to Local Business Zone 1, BE APPROVED in terms of Section 98(b) of the Municipal Planning Bylaw, 2015, subject to the conditions contained in attached Annexure A
e. That the application for a Consent Use to permit shops to operate on Erf 2144, Somerset West, BE APPROVED in terms of Section 98(b) of the Municipal Planning Bylaw, 2015, subject to the conditions contained in attached Annexure A
f. That Site Development Plan no 395/0000SL 4.1 Rev J/dd 2023-02-19 BE APPROVED in terms of Section 98(b) of the Municipal Planning Bylaw, 2015, subject to the conditions contained in attached Annexure A
Condition 2.2 is amended as follows:
2.2 That a Landscaping Plan be submitted for approval prior to submission of building plans and must be implemented at the cost of the owner within 6 months of utilising the property for retail purposes.
REASONS FOR DECISION:
The MPT APPROVED the application for the reasons in the Planner’s report and added an additional 6.1.5 that read as follows:
Reasons for the recommended decision for approval of the removal of restrictive title deed conditions may be summarised as follows:
6.1.5. The removal of the tittle deed was assessed in terms of Section 39.5 of LUPA and Section 47 of SPLUMA and found to be compliant.
