RESOLVED by 3 votes to 2 that:
a. The application for Permanent Departures relating to the boundary wall as set out in Annexure A, in respect of erf 454 Clifton BE APPROVED in terms of Section 98(b) of the City of Cape Town Municipal Planning By-Law, 2015, subject to the conditions set out in Annexure A
b. The application for City Approval as set out in Annexure A, in respect of erf 454 Clifton BE APPROVED in terms of Section 98(b) of the City of Cape Town Municipal Planning By-Law, 2015, subject to the conditions set out in Annexure A.
REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report
Annexure A:
Amend condition 1.1 as follows:
1.1. City Approval:
1.1.1. Council’s consent in terms of Section 42(i) to permit building within the heritage protection overlay zone (HPOZ), as contemplated in item 162(1)(c) of the DMS.
Correct condition 2.2(ii) as follows:
2.2(ii) Vegetation that would either creep along the outer fence or be trained to grow to the top of the boundary fence
Add new condition 2.2(iv) as follows:
2.2(iv) That the artificial greening vegetation be removed
