Resolution details

UNANIMOUSLY RESOLVED that:
a. The removal of the restrictive title deed conditions B. 3.(b) (c) & (d) as set out in title deed T62726/1995 in respect of erf 18477, Cape Town BE APPROVED in terms of Section 98(b)(iii) of the City of Cape Town Municipal Planning By-Law, 2015.

b. The amendment of the township conditions restricting density, built-upon area and building lines to exclude erf 18477, Cape Town (Tijgerhof) BE APPROVED in terms of Section 98(b)(iii) of the City of Cape Town Municipal Planning By-Law, 2015.

c. The rezoning of erven 18477 and 18478, Cape Town, from Single Residential 1 (SR1) to General Residential 1(GR1) BE APPROVED in terms of Section 98(b)(iii) of the City of Cape Town Municipal Planning By-Law, 2015, subject to the as set out conditions in Annexure A.



d. The consolidation of erven 18477 and 18478, Cape Town BE APPROVED in terms of Section 98(b)(iii) of the City of Cape Town Municipal Planning By-Law, 2015, subject to the conditions as set out in Annexure A.

e. The permanent departure to permit the Meurant street building line to be 2.035m in lieu of 5.000m for the consolidated erven 18477 and 18478, Cape Town BE APPROVED in terms of Section 98(b)(i) of the City of Cape Town Municipal Planning By-Law, 2015.

f. The permanent departure to permit a density 66 units per hectare in lieu of 35 units per hectare for the consolidated erven 18477 & 18478, Cape Town BE APPROVED in terms of Section 98(b)(i) of the City of Cape Town Municipal Planning By-Law, 2015.

g. The site development plan (Annexure D3 of the report) for consolidated erven 18477 and 18478, Cape Town BE APPROVED in terms of Section 98(b)(iii) of the City of Cape Town Municipal Planning By-Law, 2015, subject to the conditions as set out in Annexure A.

REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report and agreed to add reason 7.1.4 as follows:

7.1.4 In the assessment of the application, due regard was given to Section 39(5) of LUPA and Section 47 of SPLUMA

Update numbering sequence in paragraph 7.2 of the reasons

Annexure A:
Amend condition 2.1 as follows:
LAND USE MANAGEMENT
2.1 Building plans to be submitted for approval in terms of the National Building Regulations and Standards Act, shall be substantially in accordance with Site Development Plans, bearing plan reference. 18477/1.1 – rev C dated June 2023 attached as Annexure D.3 with due cognizance of the conditions contained therein

Reference to Director: Environmental & Heritage Management (Environmental Resources Management) in condition 2.23 must be changed to be Director: Environmental Management
