UNANIMOUSLY RESOLVED that:
An administrative penalty of R 2 500.00 BE DETERMINED for the unauthorised building work in terms of section 98(b) of the City of Cape Town Municipal Planning By-Law, 2015 on erf 241 at 12 Flamink Street, Somerset West

REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report and agreed to the following changes:

Amend reason 2 as follows:
2 The owner's conduct was mainly due to negligence but has been cooperative in regularising the unlawful building work on the property.

Amend reason 4 as follows:
4 The building work is for habitable structures over the street building line which is visually detracting from the streetscape of the property.

Add new reason 6 as follows:
6 The extent of the contravention is relatively small
