RESOLVED by the Chairperson’s casting vote that:
An administrative penalty of R 1 200.00 BE DETERMINED for the unauthorised land use in terms of section 98(b) of the City of Cape Town Municipal Planning By-Law, 2015 in respect of Erf 934 at 10 Sopraan Street, Macassar.

REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report and agreed to the following changes:

Amend reason 2 as follows:
2 The owner's conduct was mainly due to possible negligence but has been cooperative in regularising the unlawful land use on the property.

Amend reason 3 as follows:
3 The gravity of the unlawful land use is considered to be serious, however, a previous approval was granted and nothing has changed

Amend reason 4 as follows:
4 The duration of the unlawful land use is approximately 6 years, which is long, and the extent of the unauthorised land use is large
