UNANIMOUSLY RESOLVED that:
a. An amendment of the approved Precinct Plan and Bulk Register for Precinct 1 and in particular the Historic Sub-Precinct, to allow for further development on Erf 19308 at 1 De Beers Avenue, Historic Sub-Precinct, Precinct 1, Paardevlei, Somerset West BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015 subject to the conditions contained in Annexure A
b. An amendment of the approved site development plan for the abovementioned Erf 19308, to allow for the development of educational facilities (crèche) with a floor area of 564m2 and corporate offices with a GLA of 1316m2 BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015 subject to the conditions contained in Annexure A
REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report and agreed to the following changes:
Correct the numbering sequence contained in the reasons
Add new reason 7.1.10 as follows:
7.1.10 The objections to the development proposal have been appropriately and satisfactorily addressed
Add new reason 7.1.11 as follows:
7.1.11 The development proposal satisfies the development principles contained in Section 7 of the Spatial Planning and Land Use Management Act (2013) and Section 59 of the Land Use Planning Act (2014)
Add new reason 7.1.12 as follows:
7.1.12 The development proposal is supported by Heritage Western Cape as well as Council’s Services and Line Departments
Annexure A
Correct condition 1.2 as follows:
1.2 That no non-work-related functions/activities hosted by the occupant/s of the office building or any other person be permitted on the second floor deck after 20h00 on weekdays or at any time over weekends or public holidays and that furthermore no amplified broadcasting (i.e. announcements / speeches / music) be permitted on/from the said second floor/deck
Correct condition 1.3 as follows:
1.3 That all signage shall be to the satisfaction of the authorised official in terms of the City’s Outdoor Advertising and Signage By-Law and that a signage application for all advertising signage with a square area greater than 0.2m² be submitted for approval prior the erection thereof
