RESOLVED UNANIMOUSLY:
The application for Permanent Departure in terms of Section of the City of Cape Town Municipal Planning By-Law,2015 to permit second dwelling on the 1st floor to be set back 1.0m in lieu of 3.5m from the street, BE APPROVED in terms of Section 98 (b) of the Municipal Planning By-law, 2015 in accordance with plan no Erf 16756, Kraaifontein (Paarl), drawn by Iaan Kotze.
REASONS FOR DECISION:
The MPT APPROVED the application for the reasons in the Planner’s report, except reason 7.1.4 which is amended and added an additional reason 7.1.9 which read as follows:
7.1.4. The position of the second dwelling on the footprint of the existing garage closer to the street than the prescribed distance in the Development Management Scheme, is not considered to pose a negative impact to the streetscape. The adjoining road verge is approximately 2.7m wide. With the intended 1m, the proposed second dwelling will still be 3.7m from the actual road way.
7.1.9. That the second dwelling unit is located south of the objector’s property and is not likely to cause shadows over that property
