Resolution details

UNANIMOUSLY RESOLVED that:
a. The deletion of previous conditions of approval in order to permit a mixed-use development on erf 3495 Parklands, BE APPROVED in terms of section 98(b) of the Municipal Planning By-Law, 2015, subject to the conditions set out in Annexure A.

b. The departure to permit building work at 1.5m in lieu of 4.5m from the north street boundary (Sandown Road East Street) on erf 3495 Parklands, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015, subject to the conditions set out in Annexure A.

c. The departure to permit building work at 1.5m in lieu of 4.5m from the east street boundary (Wood Drive) on erf 3495 Parklands, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015, subject to the conditions set out in Annexure A.

Recommendation 8.4 is deleted as the parking departure is no longer required as PT maps have been adopted and parking is no longer affected

d. The location of parking bays 146 and 147 located closer than 10 from the south-west street boundary (Stonebridge End), BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015, subject to the conditions set out in Annexure A.

e. The site development plan for erf 3495 Parklands, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015, subject to the conditions set out in Annexure A.

REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report and agreed to add a reason as follows:

7.1.13 The PT zones are operable and therefore a parking departure is no longer required








Annexure A
Delete condition 1.5

Amend condition 2.1 as follows:
2.1 Building plans must be submitted generally in accordance with the landscaping plan attached as Annexure C3b with Drawing No. 2019/Erf3495/LP/101; dated May 2022. Upon building plan submission the layout of the guest units must comply with the definition of a hotel as per the DMS

Amend condition 2.2 as follows:
2.2 Revised building plans illustrating a continuous planter along the boundary walls facing onto Sandown Road and Wood Drive, shall be submitted generally in accordance with the plans attached as Annexure C3a with Drawing No: S-1.9.5, dated 22/06/2022 (sheet 2 of 8 plans)

Amend condition 2.3 as follows:
2.3 The proposed development shall be limited to flats of 60 dwelling units and a hotel of 60 x guest units. Should the developer wish to construct any alterations not in general accordance with the current site development plan approval, submission shall be made to the department for the amendment of the site development plan.

Delete condition 2.7
