RESOLVED UNANIMOUSLY that:
An administrative penalty in the amount of R2 700.00 BE DETERMINED in terms of Item 129 of the City of Cape Town Municipal Planning By-Law, 2015 in respect of Erf 36677, Bellville in accordance with Annexure B.
REASONS FOR DECISION:
The MPT APPROVED the application for the reasons in the Planner’s report, except reason 6.4 which is amended as follows:
6.4. The conduct of the owner/operator is viewed as constituting a wilful contravention of the MPBL, 2015 as well as a misrepresentation of the duration of the contravention. This warrants an increase in the penalty amount.
