RESOLVED UNANIMOUSLY:
That the application made in respect of Erf 171, Goodwood for the removal of restrictive title conditions, clauses B. (c) and (d) as contained in title deed T060273/09 BE APPROVED in terms of Section 98(b) of the Municipal Planning By-law, 2015.
REASONS FOR DECISION:
The MPT APPROVED the application for the reasons in the Planner’s report
1. Retaining the restrictive condition, no longer presents a social or other benefit.
2. Removal of the title deed condition will not have any financial or other value impact on any person or entity.
3. The proposal will not have a negative impact on the surrounding properties as no new land use, not already prevalent in the area, is proposed.
4. The proposal has been considered in terms of Section 39(5) of LUPA and Section 47 of SPLUMA. As discussed in the report and per the applicant’s motivation, it is considered that there will not be deprivation of rights or benefits of the parties involved.
5. The proposal satisfies the desirability criteria contained in section 99 of the Municipal Planning Bylaw, 2015.
6. The proposal is in line with the principles in Section 7 of SPLUMA and section 59 of LUPA.
