Resolution details

RESOLVED UNANIMOUSLY that:

a. The application for rezoning of Erf 50642 Cape Town at Claremont, from Single Residential Zone 1 to General Residential Subzone GR4, BE REFUSED in terms of Section 98(c) of the Municipal Planning By-Law, 2015,

b. The application for departures, as set out in Annexure A, for Erf 50642 Cape Town at Claremont, BE REFUSED in terms of Section 98(c) of the Municipal Planning By-Law, 2015.

REASONS FOR DECISION:

The MPT REFUSED the application for the reasons set out below:

1. The scale and massing of this property in this particular section of Belvedere Road is inappropriate
2. The proposed density of a 157 dwelling units per hectare in an exclusively single residential block along Belvedere Road is not contextually appropriate
3. Whilst the property is located within the urban inner core it is not located at a local node or in a structuring corridor as per the MSDF
4. Whilst the proposed use remains residential the actual built form is incompatible with the immediate environment.
5. The proposal will have a significant impact on the biophysical environment given the proposed basement and excessive coverage which severely limits the opportunities to retain existing landscape or implement meaningful landscaping to mitigate the impact of the proposed building.
