UNANIMOUSLY RESOLVED that:
The application for subdivision of erf 471, Bantry Bay, into four (4) portions, as set out in Annexure A, BE APPROVED in terms of Section 98(b) of the City of Cape Town Municipal Planning By-Law, 2015, subject to the conditions contained in Annexure A.
REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report
Amend Annexure A as follows:
Delete condition 2.9.11
Delete condition 2.9.12
Delete condition 2.9.14
DEVELOPMENT MANAGEMENT
2.1 Prior to the submission of any building plans for development of the property, the applicant/owner shall submit a Site Development Plan, substantially in accordance with the plan on page 177 (Figure 5) of the report, showing:

Renumber duplicate 2.2 to be 2.3 as follows:
2.3 The owner shall pay a financial contribution towards the provision of bulk engineering services in the amount of R 133 636.31 calculated in accordance with the set relevant policy. Such payment shall be made prior to issuing of the Section 137 clearance certificate. It must be noted that the amount due will be escalated annually on 1 July with the Construction Price Adjustment Formula (CPAF) using the industry indices of Stats SA.
WATER AND SANITATION
Renumber old 2.9.1 to be 2.10.1 and amend as follows:
2.10.1 That each subdivided erf have a separate sewer and water connection and that such shall be installed prior to the issuing of Section 137 clearance certificate
Move paragraph 2.9.13 forward and insert under the heading ‘Water and Sanitation’ and renumber as follows:
2.10.4 All costs relating to service connections, alterations to or provision of new water and sewerage services will be for the account of the applicant.
Under the heading ‘Electricity’, amend old paragraph 2.9.9 and renumber as follows:
2.10.9 A quote for the shared network charge and the connection fee, as well as conditions of supply, will be provided upon formal application. In the case of a subdivision application, the application for a quote must be submitted prior to application for Section 137 clearance.
Add new condition as follows:
2.10.10 The electricity connection points shall be installed prior to the issuing of Section 137 clearance certificate
Old 2.9.10 to be renumbered to be 2.10.11
