RESOLVED UNANIMOUSLY that:

That an administrative penalty in the amount of R10 000 for the unauthorised building work BE DETERMINED in terms of Section 129 of the City of Cape Town Municipal Planning By-Law, 2015 on erf 5450 Guguletu be approved in terms of Section 98(b)(i) of the City of Cape Town Municipal Planning By-Law, 2015.

REASONS FOR DECISION:

The MPT APPROVED the application for the reasons set out in the Planner’s report, except reason 6.1 which is amended as follows:

6.1 The cell mast structure’s location does not adhere to previous conditions of Consent Use approval.
