RESOLVED UNANIMOUSLY that:
a. The application for a deletion of restrictive title deed conditions, as set out in Annexure A, for Erven 42 and 44 Edward Township, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-law, 2015.
b. The application for a deletion of a condition of an existing approval, as set out in Annexure A, for Erven 42 and 44 Edward Township BE APPROVED in terms of Section 98(b) of the Municipal Planning By-law, 2015.
c. The application for the consolidation of Erven 42 and 44 Edward Township in accordance with the Plan of Consolidation, Plan No: edward42&44; Rev No: 01; Drawn by JK Muanda and dated September 2020, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-law, 2015.
d. That the application for rezoning of the consolidated property comprising Erven 42 and 44 Edward Township from Single Residential 1 (SR1) to General Residential 2 (GR2) BE APPROVED in terms of Section 98(b) of the Municipal Planning By-law, 2015, subject to the conditions contained in Annexure A.
e. That the application for permanent departures, as set out in Annexure A, for the consolidated property comprising Erven 42 and 44 Edward Township BE APPROVED in terms of Section 98(b) of the Municipal Planning By-law, 2015.
f. The application for Council approval of the Site Development Plan for the consolidated property comprising of Erven 42 and 44 Edward Township in accordance with the drawings referenced – Project No: OT001; Drawing No. 001, dated 22.10.2019 and Drawing No. 002-005 dated 15.06.2020 and attached hereto as Annexure C, BE APPROVED in terms of Section 98 of the City of Cape Town Municipal Planning By-law, 2015.
Conditions 2.9.1 is amended as follows:
2.9.1 A Landscape Plan must be submitted as part of the building plan submission to address parking, road verges and private gardens for the approval by the authorized official
Condition 2.9.2 is deleted
REASONS FOR DECISION:
The MPT APPROVED the application for the reasons set out in the Planner’s report, except reasons 7.1.2 and 7.1.10 which is amended as follows:
7.1.2 The proposed development aligns with the principles in, and contributes to achieving objectives set out in the Integrated Development Plan, Economic Growth Strategy and Social Development Strategy as it creates a greater range of residential accommodation within a well-located area.
7.1.10 The proposal has been evaluated in terms of Section 39(5) of the Land Use Planning Act 2014 and Section 47 of the Spatial Planning and Land Use Management Act, 2013 and it is considered that the social benefit / public interest to the broader community outweigh any benefits to the immediate property owners and those who are the beneficiaries of the restrictions.
