RESOLVED UNANIMOUSLY that:
a. The application in respect of Remainder Erf 128992, Cape Town for the rezoning from Open Space (OS2) to Subdivisional Area BE APPROVED in terms of section 98(b) of the City of Cape Town Municipal Planning By-law, 2015, in accordance with land uses indicated in the subdivision plan no. 5.005_3.01_2, dated 27/02/2020 included with Annexure C subject to the conditions contained in Annexure A.
b. The application for the subdivision in respect of Remainder Erf 128992, Cape Town into into 129 portions, BE APPROVED in terms of section 98(b) of the City of Cape Town Municipal Planning By-law, 2015 in accordance with the plan of subdivision plan no. 5.005_3.01_2, dated 27/02/2020 included with Annexure C, subject to the conditions contained in Annexure A.
c. That in respect of the approvals granted under 8.1 and 8.2 above, the deviation from the Tygerberg District Plan that designates Remainder Erf 128992, Cape Town for open space purposes, BE NOTED.
Conditions 2.1, 2.1.4 and 2.23 are amended as follows:
2.1. That the development shall be in accordance with the subdivision plan attached, drawing Nr. 5.005.2.3.01.4 dated 23 October 2020.
2.14 That a Stormwater Management Plan (SWMP) for the ultimate development must be submitted prior to Civil Engineering Design Drawing submission, which addresses critical stormwater management issues and that the SWMP gives consideration, to the site zoned for utility purposes, being used for shared outdoor sport and recreation, if possible, to the standards and specifications of this Department.
2.23 That submission of a detailed Landscape Plan (LP) is required prior to final Building Plan approval. The LP shall be to the satisfaction of the authorized official and in accordance with the standards and specifications required by the Environmental & Heritage Management Department and the Recreation and Parks Department. The landscape plan shall include adequate tree planting along street verges and on the open space and underground services must be indicated on such plan to demonstrate that sufficient space has been allocated for tree planting.
Additional condition
2.24 That before the developer can proceed with the preparation of the site and installation of services the public open space must first be closed in terms of relevant legislation.
REASONS FOR DECISION:
The MPT APPROVED the application for the reasons set out in the planner’s report except reason 7.1.3 which is amended as follows:
7.1.3 That the deviation from the Tygerberg District Plan is warranted because the property will be used more efficiently and in a manner which is more closely aligned to Council’s policies.
