RESOLVED UNANIMOUSLY that:

An administrative penalty in the amount of R40 000.00 BE DETERMINED in terms of Section 129 of the City of Cape Town Municipal Planning By-Law, 2015 in respect of Erf 65106 Cape Town at Kenilworth, with regard to the non-compliance with conditions of approval relating to the maximum number of learners on the property as well as to on-site parking provision.

REASONS FOR DECISION:

The MPT APPROVED the application for the reasons set out in the Planner’s report and added an additional reason that read as follows:

6.8 This is a serious contravention specifically because of the number of learners involved and the history of willful conduct by this applicant and this warrants a higher penalty
