UNANIMOUSLY RESOLVED that:
a. An administrative penalty of R0 BE DETERMINED in terms of Section 129 of the City of Cape Town Municipal Planning By-Law, 2015 in respect of Erf 20884, Table View, for the covered terrace, and such penalty be approved in terms of Section 98(b) of the said By-Law; and
b. An administrative penalty of R 250.00 BE DETERMINED in terms of Section 129 of the City of Cape Town Municipal Planning By-Law, 2015 in respect of Erf 20884, Table View, for the unlawful tool shed, and such penalty be approved in terms of Section 98(b) of the said By-Law.
REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report and agreed to amend reason 6.1 as follows:
6.1 The covered terrace was erected by a previous owner and hence the current owner should not be held liable.
