UNANIMOUSLY RESOLVED that:
a. The removal of restrictive title deed conditions (ii) A (a; b; c and d) in title deed T65856/2011 on erf 5326 at 21 Fairway Way, Milnerton BE APPROVED in terms of Section 98(b)(iii) of the Municipal Planning By-Law, 2015.



b. The deletion of the township establishment conditions of approval as referred to in conditions (ii) A (a; b; c and d) in title deed T65856/2011 to allow for the development of an early childhood development centre on erf 5326 at 21 Fairway Way, Milnerton BE APPROVED in terms of Section 98(b)(iii) of the Municipal Planning By-Law, 2015,

c. The consent use to allow for a place of instruction (early childhood development centre) on erf 5326 at 21 Fairway Way, Milnerton BE APPROVED in terms of Section 98(b)(iii) of the Municipal Planning By-Law, 2015, subject to the conditions set out in Annexure A.

d. The regulation departure proposed for erf 5326 at 21 Fairway Way, Milnerton BE APPROVED as set out in Annexure A, in terms of Section 98(b)(iii) of the Municipal Planning By-Law, 2015, subject to the conditions contained in Annexure A.

REASONS FOR DECISION
The MPT APPROVED the application for the reason set out in the Planner’s Report.

Amend Annexure A
Replace paragraph 2.3 with the following:
2.3 The ECD facility is to be restricted to 60 children only

Delete paragraph 2.7

Replace paragraph 2.9 with the following:
2.9 In terms of Section 8.1 of the Development Charges (DC) Policy for Engineering Services for the City of Cape Town (Approved Policy C41/05/14-29 May 2014) development charges apply to this application. The total amount payable for the proposed land use rights in accordance with the attached DC calculation is R117 134.52. It must be noted that the amount due will be escalated annually on 1 July with the Construction Price Adjustment Formula (CPAF) using the industry indices of StatsSA.
