UNANIMOUSLY RESOLVED that:
An administrative penalty of R 2 000.00 BE DETERMINED in terms of Section 129 of the City of Cape Town Municipal Planning By-Law, 2015, for the unauthorised building work (timber deck and stairs) on Erf 26912 Cape Town which contravenes the DMS.
REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report and agreed to amend reason 6.4 as follows:
6.4 The gravity is moderately serious given the location of the deck above ground floor on the common boundary and overlooking abutting properties.
