UNANIMOUSLY RESOLVED that:
a. The application for Consent as set out in Annexure A on Remainder Erf 2825 Oranjezicht, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015, subject to the conditions contained in Annexure A.
b. The applications for City Approval as set out in Annexure A on Remainder Erf 2825 and Erf 2826 Oranjezicht, BE APPROVED in terms of Section 98 (b) of the Municipal Planning By-law, 2015, subject to the conditions contained in Annexure A.
c. The application for Departures as set out in Annexure A on Remainder Erf 2825 Oranjezicht, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015, subject to the conditions contained in Annexure A.
d. The application for City Approval and Departures as set out in Annexure A on Remainder Erf 2825 and Erf 2826 Oranjezicht, BE REFUSED in terms of Section 98(c) of the Municipal Planning By-Law, 2015.
REASONS FOR DECISION
The MPT partially APPROVED and partially REFUSED the application for the reasons set out in the Planner’s Report.
Amend Annexure A:
1.2. City Approval (erven 2825 & 2826)
Delete paragraph ‘b’
1.3 Departures:
a) Item 57(b)(i): To permit the width of the carriage way crossings over the street boundary to exceed 8m (9.250m and 9.500m) on erf 2825
b) Schedule 8(58/79) Condition 2.1: The nett retail of the convenience store shall not exceed 100m² 184m² on erf 2825
3.1 Notwithstanding uses permitted in the General Business 1 zoning of the Development Management Scheme, the uses on erf 2825 shall be limited to a service station, the sale of motor vehicles, the operation of a convenience store and fast-food take-away facility.
Delete paragraph 3.5
Add new condition as follows:
A landscaping plan which includes the mitigation measures offered by the applicant and screens both sides of the brick wall along Forest Hill road, as well as measures to minimize light spillage to be submitted to the authorized official.
