UNANIMOUSLY RESOLVED that:
a. Application for Consent Use in terms of in terms of Section 42(i) of the City of Cape Town Municipal Planning By-Law, 2015 in order to allow for the proposed construction of the warehouse building located on erf 1632 at 13 Piet Retief Street, Strand BE REFUSED in terms of Section 98(c) of the Municipal Planning By-Law, 2015.

b. Application for Regulation Departure in terms of in terms of Section 42(b) of the City of Cape Town Municipal Planning By-Law, 2015 in order to allow for the under provision of vehicle parking bay to be 7 parking bays in lieu of 8 parking bays on erf 1632 at 13 Piet Retief Street, Strand BE REFUSED in terms of Section 98(c) of the Municipal Planning By-Law, 2015.


REASONS FOR DECISION
The MPT REFUSED the application for the reasons set out in the Planner’s Report and agreed to amend the reasons as follows:

6.1.2 The scale and massing of the building deviates from the built form of the area. The structure will be constructed using corrugated iron sheeting similar to that of an industrial building, this will change the look and feel of the area. The built form would be greatly compromised.

6.1.5 Piet Retief is a collector road with narrow road reserve and designated on street parking, with numerous public amenities already existing within close proximity of the subject property.
