RESOLVED UNANIMOUSLY that:
a. The application for rezoning of Remainder Erf 86347 Cape Town at Muizenberg, from Single Residential Zone 1 to General Residential Subzone GR4, BE REFUSED in terms of Section 98(c) of the Municipal Planning By-Law, 2015.
b. The application for departures, as set out in Annexure A, for Remainder Erf 86347 Cape Town at Muizenberg, BE REFUSED in terms of Section 98(c) of the Municipal Planning By-Law, 2015.
c. The application for Council’s approval to permit building work and change of use in a Heritage Protection Overlay Zone, as set out in Annexure A, for Remainder Erf 86347 Cape Town at Muizenberg, BE REFUSED in terms of Section 98(c) of the Municipal Planning By-Law, 2015.
REASONS FOR DECISION:
The MPT REFUSED the application for the reasons set out in the Planner’s report, except reason 7.1.4 which is amended as follows:
7.1.4. Numerous external changes to the approved building are proposed, and the appearance of the building is disjointed and with numerous ad-hoc additions. This has resulted in a building that is unsympathetic to its context.
