RESOLVED UNANIMOUSLY that:

a. The application for deletion of restrictive title deed conditions, as set out in Annexure A, for Erf 164592 Cape Town at Newlands, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015.

b. The application for the subdivision of Erf 164592 Cape Town at Newlands, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015, as per plan of subdivision LUM/00/164592, subject to the conditions contained in Annexure A.

c. The application for departures, as set out in Annexure A, for Erf 164592 Cape Town at Newlands, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015.

REASONS FOR DECISION:

The MPT APPROVED the application for the reasons set out in the Planner’s report, except reason 7.1.4 which is amended as follows:

7.1.9 The double storey form of the development means that the coverage is reduced and space for landscaping is maximized. Some trees will be able to be retained, and new trees will be planted. A landscaping plan will be required as a condition of approval
