RESOLVED that:
An administrative penalty in the amount of R 2 000.00 BE APPROVED in terms of Section 98(b) of the City of Cape Town Municipal Planning By-Law, 2015, in respect of the unauthorised land use and building work on Erf 1742, 140 Beverly Road, Devon Park Village, Eerste River.

REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report and agreed to add:

With respect to reason 6.2, no health and safety clearances are in place, and this warrants a higher penalty as vulnerable children are placed at risk.
