UNANIMOUSLY RESOLVED that:
An administrative penalty of R 2 000.00 BE DETERMINED in terms of Section 129 of the City of Cape Town Municipal Planning By-Law, 2015 in respect of Erf 206 Fresnaye, 2A Avenue Des Huguenots, Fresnaye.

REASONS FOR DECISION
The MPT APPROVED the application for the following reasons:

1. Despite the previous building plan approval, there is no clear explanation from the applicant for why the extensively large voids were created in the first place and some penalty is warranted in this regard
2. The applicant has previously contravened the Municipal Planning By-Law
3. A departure application was submitted but was withdrawn by the applicant
4. It was determined that a minimal penalty be approved because the City of Cape Town erroneously approved the previous building plan
