RESOLVED that:
a. The application for relaxation of a restrictive title deed condition, as set out in Annexure A, for Remainder Erf 680 Constantia, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015.
b. The application for the deletion of a condition of a previous approval, as set out in Annexure A, for Remainder Erf 680 Constantia, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015.
c. The application for the amendment of an approved subdivision plan by replacing the plan of subdivision LUM/16/680 with LUM16/680/1, for Remainder Erf 680 Constantia, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015.
d. The application for a departure, as set out in Annexure A, for Remainder Erf 680 Constantia, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015.
REASONS FOR DECISION:
The MPT APPROVED the application for the reasons set out in the planner’s report except for reason 7.1.1 which is amended as follows:
7.1.1 The proposal will not change the character of the area and will not have a material negative impact on neighbouring properties.
