RESOLVED UNANIMOUSLY that:
An administrative penalty in the amount of R40 000.00 BE DETERMINED in terms of Section 129 of the City of Cape Town Municipal Planning By-Law, 2015 respect of the unauthorised guest house and building work on Remainder Erf 13 Chapman’s Peak, as shown on the plans drawn by Teresa Jackson Architectural Designer with drawing numbers 16/12/2019 numbers 1 – 6, all dated 17-12-2019.
REASONS FOR DECISION:
The MPT APPROVED the application for the reasons set out in the Planner’s report and added an additional reason that read as follows:
6.1.10 Given the nature and scale of the contravention as well as the willful conduct it warrants a higher penalty.
