RESOLVED UNANIMOUSLY that:
a. The application for the rezoning of Erf 4327 Ottery from Single Residential 1 Zone (SR1), General Residential 2 Zone (GR2) and Open Space 2 Zone (OS2) to Sub Divisional Area Overlay Zone for residential, open space, retail, office, crèche (Place of Instruction), utilities and private road purposes in accordance with the plan titled “Proposed Subdivision & Rezoning Plan”, prepared by Urban Dynamics and dated August 2019 BE APPROVED in terms of Section 98(b) of the City of Cape Town Municipal Planning By-law, 2015, subject to the conditions contained in Annexure A attached hereto.
b. The application for the the Subdivision of Erf 4327 Ottery into 14 portions (4 x General Residential 2 (GR2) portions; 1 x General Business 1 portion; x Transport 2 Zone (TR2) portion; 2 x Open Space 3 Zone (OS3) portions; 6 x Utility Zone (UT) portions) in accordance with the plan of subdivision titled “Proposed Subdivision Plan with Dimensions”, prepared by Urban Dynamics and dated April 2020 which includes the proposed street names and the plan titled “Proposed Subdivision & Rezoning Plan”, prepared by Urban Dynamics and dated August 2019 attached hereto as Annexure C1 and C2 respectively, BE APPROVED in terms of Section 98(b) of the City of Cape Town Municipal Planning By-law, 2015, subject to the conditions contained in Annexure A attached hereto.
c. The application for Consent to permit a Place of Assembly (Clubhouse or Gymnasium for residents’ use only) on Portions D, E and F (Zoned General Residential 2), BE APPROVED in terms of Section 98(b) of the City of Cape Town Municipal Planning By-law, 2015, subject to the conditions contained in Annexure A attached hereto.
d. The application for Permanent Departures to permit relaxations relating to street and common boundary setbacks, on-site parking provision and carriageway crossing widths as set out in Annexure A, attached hereto, BE APPROVED in terms of Section 98(b) of the City of Cape Town Municipal Planning By-law, 2015 in accordance with the plan titled “Proposed Setback Departure Plan” drawn by Urban Dynamics and dated August 2019 and attached hereto as Annexure C3, subject to the conditions contained in Annexure A attached hereto.
e. The application for Council approval of the Site Development Plan (Including Landscape Master Plan - Drawing No. 087.02, Revision F and dated 14.08.2019) for the General Residential 2 (GR2) portions only, titled Golden Grove Estate Integrated Development, Site Development Framework, Drawing No 1819 SK PL, Revision R12, dated 04 February 2020, drawn by Jakupa Architects and attached hereto as Annexure C4, BE APPROVED in terms of Section 98 of the City of Cape Town Municipal Planning By-law, 2015.
f. The application for Council approval to allow parking at ground level within 10m of a public street (De Wet Road) BE APPROVED in terms of Section 98 of the City of Cape Town Municipal Planning By-law, 2015.
REASONS FOR DECISION:
The MPT APPROVED the application for the reasons set out in the Planner’s report and added two additional reasons that reads as follows:
7.1.9 The proposal satisfies the desirability criteria contained in Section 99 of the Municipal Planning By-Law, 2015
7.1.10 Cognisance and adherence to the development principles contained in both SPLUMA and LUPA is achieved
