UNANIMOUSLY RESOLVED that:
An administrative penalty in the amount of R20 000.00 BE DETERMINED in terms of Section 129 of the City of Cape Town Municipal Planning By-Law, 2015 in respect of Remainder Erf 55387 Cape Town at Claremont in respect of the habitation of dwelling units on unregistered erven which results in 6 dwelling units on the property zoned Single Residential Zone 1.
REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report and agreed to the following amendments:
6.3 The gravity of the contravention is considered to be serious.
Add new: Given the conduct, scale and several previous contraventions by the developer, the contravention warrants a higher penalty
