UNANIMOUSLY RESOLVED that:
a. That the application for Consolidation of Erven 15368 and 15369, Somerset West as per Consolidation Drawing prepared by R.A Pesch dated December 2003, BE APPROVED in terms of Section 98(B) of the Municipal Planning By-Law, 2015 subject to the conditions contained in Annexure A.
b. That the application for Rezoning of the proposed consolidated Erven 15368 and 15369, Somerset West from Single Residential Zone 1 to General Residential Subzone 2 to permit the development of 4 two-storey block of flats, BE APPROVED in terms of Section 98(B) of the Municipal Planning By-Law, 2015 subject to the conditions contained in Annexure A.
c. That the application for Permanent Departure for the relaxation of the common building line (adjacent to Erf 4487) from 4.5m to 0m for the proposed garages, BE APPROVED in terms of Section 98(B) of the Municipal Planning By-Law, 2015.
d. That the application for Permanent Departure for the relaxation of the common building line (adjacent to Erf 4487) to permit the balcony of Block D to be set back 3.0m in lieu of 4.5m from the relevant common building line, BE APPROVED in terms of Section 98(B) of the Municipal Planning By-Law, 2015.
Conditions 2.1, 2.5. 2.19 and 2.29 are amended as follows:
2.1 That the development shall be substantially in accordance with the following plans:
• Consolidation Diagram prepared by R.A. Pech dated December 2003;
• Site Development Plan No 14/81 dated April 2019;
• Site Development Plan No 14/81/02 dated April 2019;
• Site Development Plan No 14/81/03 dated April 2019;
• Site Development Plan No 14/81/04 dated April 2019;
• Site Development Plan No 14/81/05 dated April 2019;
2.5 That the Development Contributions has been determined at R311 430.78 and is subject to annual escalation up to date of payment. The amount payable will therefore be the amount as calculated at the time that payment is made. Breakdown of Development Contributions is indicated in the table below:

2.19 That the Developer/Owner shall provide a refuse embayment and the refuse room be relocated adjacent to the refuse embayment on the southern side of the entrance of the property.
2.29 That a revised detailed landscaping plan substantially in accordance with the detailed landscape plan (Drawing No. LAND20191028 dated 24/02/2020) to incorporate additional planting on the site and especially along the entire perimeter to be approved by the authorized official.
To be implemented by and at the cost of the Developer within 3 months after the completion of building works or prior to occupation, whichever may come first.
REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report except reasons 5.1.2 and 5.1.10 which are amended as follows and reason 5.1.6 is deleted
5.1.2 The application is consistent with the key considerations contained in the City’s forward Planning framework plans in terms of land use intensification and the future urban form of Cape Town.
5.1.10 All services departments concerned indicate that, external services capacity is sufficient to accommodate the proposed development.
