RESOLVED that:
a. The application for consolidation of the Erven 16971-16974 and 16976 Paarden Eiland, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015, in accordance with the consolidation diagram attached as Annexure C3.

b. The application for rezoning of the Erven 16971-16974 and 16976 Paarden Eiland from General Industrial (GI2) to Mixed Use 3 (MU3), BE REFUSED in terms of Section 98(c) of the Municipal Planning By-Law, 2015.

c. The application for permanent departures for Erven 16971-16974 and 16976 Paarden Eiland, as set out in Annexure A, BE REFUSED in terms of Section 98(c) of the Municipal Planning By-Law, 2015.

REASONS FOR DECISION
The MPT partially APPROVED the application for the reasons set out in the planners’ report, and partially REFUSED the application for the following amended reasons:

7.2.1 The proposal has spatial consistency in the context of both the MSDF and relevant DSDF, however, its current form is not deemed appropriate in terms of Section 99(3)
7.2.2 The proposed rezoning and departures will facilitate a specific type of mixed land use which includes an unacceptably dominant residential component which is not considered to be desirable in this context of a well-functioning industrial area
7.2.3 The proposed residential density is excessive and well beyond the District Plan guidelines
7.2.5 The proposal results in a built form which is considered to be inappropriate

Delete 7.2.4

Add new: The level of affordable housing and the quantum that’s provided is considered to be inappropriate in terms of the scale of the development

Note: In the event of a further application for mixed use development being submitted for this particular property, that due consideration be given to affordable housing as part of such development
