RESOLVED UNANIMOUSLY that:

a. The application for the deletion and amendment of restrictive title deed conditions, as set out in Annexure A, for Erf 10052 Hout Bay, BE APPROVED in terms Section 98(b) of the Municipal Planning By-Law, 2015.

b. The application for the deletion and amendment of conditions of an existing approval, as set out in Annexure A, for Erf 10052 Hout Bay, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015.

c. The application for the subdivision of Erf 10052 Hout Bay, as per plan of subdivision LUM/33/10052A, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015, subject to the conditions contained in Annexure A.

d. The application for a departure, as set out in Annexure A, for Erf 10052 Hout Bay, BE APPROVED in terms of section 98(b) of the Municipal Planning By-Law, 2015.

REASONS FOR DECISION:

The MPT APPROVED the application for the reasons set out in the Planner’s report and added an additional reason that reads as follows:


7.1.13 That there will be no significant negative impact on the beneficiaries of the restrictions in the title deed.
