UNANIMOUSLY RESOLVED that:
a. An administrative penalty in the amount of R 1 000.00 for the unauthorised land use (ECD centre) BE DETERMINED in terms of Section 98(b) of the City of Cape Town Municipal Planning By-Law, 2015, in respect of Erf 10074, 33 Kameeldoring Crescent, Lentegeur, Mitchells Plain.
b. An administrative penalty in the amount of R0 for the unauthorised building work BE DETERMINED in terms of Section 98(b) of the City of Cape Town Municipal Planning By-Law, 2015, in respect of Erf 10074, 33 Kameeldoring Crescent, Lentegeur, Mitchells Plain.
REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report and agreed to add the following:
6.5 The size of the ECD (10 children) is considered to be a mitigating factor
