UNANIMOUSLY RESOLVED that:
a. The application for City’s consent to permit a freestanding base telecommunication station (FSBTS), on erf 12708 at 41 Marsden Road in Walmer Estate Cape Town, BE REFUSED in terms of Section 98(c) of the Municipal Planning By-Law, 2015

b. The application for permanent departure to permit a setback from the common and street boundary building line to accommodate a freestanding base telecommunication station (FSBTS) on erf 12708 at 41 Marsden Road in Walmer Estate Cape Town, BE REFUSED in terms of Section 98(c) of the Municipal Planning By-Law, 2015

c. The application for permanent departure deviate from Scenic Route regulations to accommodate a freestanding base telecommunication station (FSBTS), on erf 12708 at 41 Marsden Road in Walmer Estate Cape Town, BE REFUSED in terms of Section 98(c) of the Municipal Planning By-Law, 2015

REASONS FOR DECISION
The MPT REFUSED the application for the following reasons:

1. The location closest to adjoining residential properties is inappropriate
2. A cell mast in this location will have a negative visual impact, which impedes the view of Devil’s Peak
3. An alternative location for the cell mast must be considered
