RESOLVED UNANIMOUSLY that:
a. The application for a departure, as set out in Annexure A, for Erf 16022 Fish Hoek, BE REFUSED in terms of Section 98(c) of the Municipal Planning By-Law, 2015.
b. The application for Council’s consent in terms of a title deed condition, as set out in Annexure A, for Erf 16022 Fish Hoek, BE REFUSED in terms of Section 98(c) of the Municipal Planning By-Law, 2015.
REASONS FOR DECISION:
The MPT REFUSED the application for the reasons set out below
1. The group housing scheme was designed to achieve an harmonious and unified architectural style. This proposal is in conflict with this important design principal
2. The granting of the departure will result in an unacceptable negative impact on surrounding properties.
3. The proposal is in clear conflict with the Site Development Plan.
4. The wellbeing of the surrounding area will be impacted on in a negative manner.
5. The proposal is not desirable and will have a significant negative impact on existing rights
