UNANIMOUSLY RESOLVED that:
a. The application for the deletion of a restrictive condition of title, [condition C(a), as contained in deed of transfer No. T75924/2017], so as to permit the rezoning of Erf 1378, corner of Wildeboom and Lancaster Roads, Gordon’s Bay, from Single Residential Zone 1 to Local Business Zone 2, for the development of a parking area, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015;

b. The application for the deletion of a condition in respect of an existing approval, [condition C(a), as contained in deed of transfer No. T75924/2017], so as to permit the rezoning of Erf 1378, corner of Wildeboom and Lancaster Roads, Gordon’s Bay from Single Residential Zone 1 to Local Business Zone 2, for the development of a parking area, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015;

c. The application for the rezoning of Erf 1378, corner of Wildeboom and Lancaster Roads, Gordon’s Bay, from Single Residential Zone 1 to Local Business Zone 2, for the development of a parking area, to serve the existing shopping centre development on adjoining Erf 8039, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015, subject to the conditions contained in Annexure A hereto

REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report and agreed to:

Amend 3rd bullet point as follows:
The proposal amounts to contextually appropriate land use and mixed use intensification, which provides for the changing needs of the inhabitants of the City.

Add new reason:
The proposal complies with the criteria as set out in the Section 39(5) of LUPA and Section 47 of SPLUMA

Amend Annexure A:
2.1 That the development be undertaken in accordance with Plan No. 317/01, dated March 2019, by Messrs Geringer Architects, as well as the landscape plan by Messrs Viridian Consulting, dated 5 April 2019 which is to be implemented within 60 days of receiving final notification
