UNANIMOUSLY RESOLVED that:
a. The application for a permanent departure to exceed the 4m maximum permissible height in the Gordon's Bay Local Area Overlay Zone, by 1,335m, for the erection of a new dwelling on Erf 4263, 4 Rhus Street, Gordon’s Bay, BE REFUSED in terms of Section 98(c) of the Municipal Planning By-Law, 2015.
b. The application for a permanent departure, to raise the ground floor of the new dwelling on the aforesaid property to 5,91m above existing ground level, in lieu of the previously-relaxed 2,4m (actual permissible is 1,5m), on Erf 4263, 4 Rhus Street, Gordon’s Bay, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015 subject to the conditions contained in Annexure A hereto.
REASONS FOR DECISION
The MPT partially APPROVED and partially REFUSED the application for the reasons set out in the Planner’s Report.
Correct numbering sequence
Amend old reason 7.5, now renumbered to 7.6:
The encroachments could have been avoided, had the architect / developer heeded calls not to proceed and/or continue with construction work, until such time that a decision in this matter had been taken.
