UNANIMOUSLY RESOLVED that:
a. The application for the deletion of restrictive conditions of title [conditions D2(b), (c), (d),(e), and E(e) as contained in Deed of title No. T51667/2018] of Erf 5153, 97 Mills Street, Strand, so as to permit the rezoning of the property from Single Residential Zone 1 to General Business Zone 2, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015;
b. The application for the deletion of conditions in respect of an existing approval, [conditions D2(b), (c), (d) and (e), as contained in Deed of title No. T51667/2018] of Erf 5153, 97 Mills Street, Strand, so as to permit the rezoning of the property from Single Residential Zone 1 to General Business Zone 2, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015 subject to the conditions contained in Annexure A hereto.
c. The application for the rezoning of Erf 5153, 97 Mills Street, Strand from Single Residential Zone 1 to General Business Zone 2, in order to permit a Place of Instruction, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015 subject to the conditions contained in Annexure A hereto;
d. The application for permanent departures relating to the following Erf 5153, 97 Mills Street, Strand permission to allow more than a single motor vehicle crossing; permission to allow a motor vehicle crossing of 4m in width, in lieu of the required minimum width of 5m; permission to allow motor vehicles to reverse across a sidewalk; permission to allow on-site parking within 10m of the Mill Street boundary BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015 subject to the conditions contained in Annexure A hereto
REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report and agreed to add:

The proposal complies with the decision-making criteria as set out in the Section 39(5) of LUPA and Section 47 of SPLUMA
New 9th bullet point:
The departures applied for are supported by the City’s Transport branch
Amend Annexure A:
1.2 The deletion of conditions in respect of an existing approval, [conditions D2(b), (c), (d) and (e), and E(e) as contained in Deed of title No. T51667/2018] of Erf 5153, 97 Mills Street, Strand, so as to permit the rezoning of the property from Single Residential Zone 1 to General Business Zone 2

CONDITIONS IMPOSED IN TERMS OF SECTION 100 OF THE BY-LAW RELATING TO THE REZONING APPROVAL
2.1 That the development be undertaken in accordance with Plan No. GRIBB-01 / 100-o, dated 25/10/2018 and that the property only be used as a place of instruction (ECD)
